5-MeO-MIPT is uncontrolled in the United States. This means it is generally considered legal to buy, possess, and distribute (sell, trade or give).
It is possible that it could be considered an analog (of 5-MeO-DIPT, in which case, sales for human consumption or possession with the intent to ingest could be prosecuted under the Federal Analogue Act though we are unaware of any existing federal cases. (Jul 7 2005)
The DEA has stated in their March 2005 issue of Microgram, that "5-MeO- MiPT is controlled (Schedule I) as an analogue of 5-methoxy-N,N-diisopropyltryptamine (5-MeO-DIPT, also known as 'Foxy-Methoxy')."
