DOI is unscheduled in the United States. It is likely that it would be considered an analog (of DOB), in which case, sales for human consumption or possession with the intent to ingest could be prosecuted under the Federal Analogue Act though we are unaware of any such existing cases (6/21/04). DOI is regularly used in animal and in vitro research, Scheduling DOI would impose substantial costs to brain research.

Schedule III as of Oct 12 2016. "2C-phenethylamines and their salts, derivatives, isomers and salts of derivatives and isomers that correspond" to a broad definition that includes anything with a 2,5-dimethoxyphenylethamine core. Japan #
DOI is controlled as a "Designated Substance" (Shitei-Yakubutsu) by the Pharmaceutical Affairs Law, making it illegal to possess or sell (see Ref)
New Zealand #
New Zealand has a catch-all Analogues section in Schedule 3 / Class C of their drug laws that would make 2C-I, 2C-E, DOI, DOB, DOM, ephedrine, pseudoephedrine (and many others) Schedule 3 compounds in New Zealand. See for more information about this.
